An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant’s name and identifying details.
Nw Property Management Limited must pay the tenant $620.44, as set out in the table below.

Reasons

Only the tenant attended the hearing, conducted remotely.
The matter had previously been adjourned because the landlord had only recently learned of the application and needed time to prepared.
Three calls to the landlord went to voicemail. I therefore proceeded to hear the claim in the absence of the landlord.
The tenant claims that he was provided with a quote for moving costs to the landlord’s boarding house. The price was $1200 bond and $600.00 rent in advance. Upon receiving a written quote from the landlord for these sums he arranged for funds to be advanced from MSD to the landlord. He says that the agreement was that once the funds were paid he would be able to move into the premises.
However, once the funds were paid the landlord withdrew its agreement for the tenant to move into the premises.
It reimbursed him the bond of $1200 but not the rent in advance of $600.00.
[The tenant/s] wants reimbursement of the rent in advance payment.
I accept the evidence of [The tenant/s] that there was agreement for him to move into the premises which was then revoked by the landlord. The landlord should reimburse him all moneys paid in advance, including the $600.
I do not allow [The tenant/s] claim for further consequential losses. He claims that he had to sell certain items at a loss and in a hurry to be able to move into other premises. I consider those losses are not reasonably foreseeable and do not allow those.
Because the tenant has succeeded with the claim I must reimburse the filing fee.
I also consider it appropriate to order name suppression of the tenant because he has been successful.
