Both parties attended the hearing which took place by teleconference.

The landlord recorded on the tenancy agreement is [The landlord/s]. He was supported today by his wife, [Redacted], who is a joint owner of the premises, but not named as a party in the tenancy agreement.

The tenant named on the tenancy agreement is [The tenant/s]. The tenant today advised that her preferred surname is her husband’s name which is [Redacted].

The tenant’s son is also named as a party to these proceedings. He did not attend today and as he is not named as a tenant party in the tenancy agreement he is removed as a party to this order.

The landlord has applied for termination of the tenancy, rent and water arrears and refund of the bond.

At the hearing the landlord withdrew the claim for payment of water charges. The landlord stated there had been a leak at the premises.

Should the tenancy be terminated?

Rent was at least 21 days in arrears on the date the application was filed. The parties agreed to the tenancy ending on Friday 10 May 2024. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
