Reasons

Both parties attended the hearing by video conference. The Tenant attended with a support person who assisted her as English was her second language.
The landlord applied for possession, rent arrears and reimbursement of the filing fee. The Landlord advised the Tenant had vacated the property on 24 March 2024 so withdrew their claim for possession.
The tenancy commenced on 13 March 2023 and was fixed to 10 March 2024. On 5 January 2024, the Landlord served the Tenant with a section 51 termination notice because the owner wished to sell the property. The 90-day period expired on 4 April 2024.
The Landlord submitted the Tenant moved out on 24 March 2024 but gave no notice of when they were leaving to the Landlord.
As there was no notice provided by the Tenant to the Landlord, the Landlord requested rent arrears for the period of 24 March 2024– 4 April 2024. The Landlord provided a rent summary to prove this amount.
The Tenant disagreed with paying the rent arrears because they filed a cross application the day before the hearing and the Landlord never told them they needed to provide notice to the Landlord that they wanted to end the tenancy. The Tenants had just moved to New Zealand in 2023 and they understood the Landlord was meant to advise them of their rights and obligations. The cross application was also not available to the Adjudicator at the time of this hearing.
A Tenant may terminate a tenancy by providing at least 28-days notice pursuant to section 51(2B) Residential Tenancies Act 1986.
In considering the evidence, the Tenant did not give 28 days-notice to the Landlord. It is not the Landlord’s role to advise the Tenant of this obligation. For this reason, the Tenant is liable to pay the rent claimed by the Landlord.
The amount ordered is proved.
As [The landlord/s] have wholly succeeded with the claim, the Tenant must reimburse the filing fee and name suppression is granted to the Landlord.
