The landlord applied for rent arrears and an order that the tenant permit a routine inspection of the premises. Rent arrears

Ms Grey and has provided a rent summary which proves that the landlord’s rent account records arrears of $2.283.14.

That amount is reduced by $68.00. Mr Safill is adamant that he paid that amount, but it has not been acknowledged. Ms Grey does not concede that amount was paid to the landlord, and I do not have documentary proof the payment was made or received. However, as a matter of administrative convenience it makes practical sense to err on the side of lenience. Entry for inspection

The landlord must regularly inspect the premises to carry out its duties in respect to maintenance and compliance. If the landlord did not regularly inspect the premises, it is liable to lose insurance cover and a pattern of failing to inspect premises of diligent tenants like Mr Safill would result in slippage resulting in neglect by less diligent tenants not being detected and remedied promptly.

Inspections are an intrusion upon the tenant’s occupation, but they are necessary.

Section 48(2)(b) of the Residential Tenancies Act 1986 grants landlords the power to require tenants to permit inspections: The landlord may enter the premises— (a) ... (b) for the purpose of inspecting the premises, at any time between 8 o’clock in the morning and 7 o’clock in the evening on a day specified in a notice given to the tenant not less than 48 hours nor more than 14 days before the intended entry, and not more frequently than once in any period of 4 weeks...

The tenant must permit an inspection to occur. However, an order is made incorporating Mr Safill’s preference as to time, date and who may conduct the inspection.
