Both parties attended the hearing.
This is a landlord application for rent arrears, key cutting and reimbursement of the filing fee.
The tenancy commenced on 18 September 2020. The tenants were excellent tenants until 2024 when the employment situation changed for the tenants. The tenants got behind in rent arrears.
The tenants advised the Landlord on 12 February 2024 that they were looking to move out as they could not afford the rent. On 10 March 2024, the tenants advised the landlord that they were moving out in a few days as they had obtained a new rental for a lesser rent.
The landlord is claiming $$3941.43 in rent arrears as of 10 March 2024 and 28 days rent in lieu of notice.
The tenants claim that their correspondence of 12 February 2024 was 28 days’ notice or at least notice that they were terminating the tenancy.
I accept that the tenants had been upfront with the landlord about needing to leave the property but did not specify an end date for their tenancy.
I accept that the landlord was not given 28 days’ notice but was well aware of the difficulties with the rent and that the tenants were actively looking for a new home.
When the tenants advised the landlord on 10 March 2024 that they were leaving in several days, the rent arrears were $3941.43. The landlord has provided rent records that prove the amount of rent owing as of 10 March 2024.
I accept that the rent due for 28 days to cover the notice period would be $3559.92. I am reducing that sum by half to reflect the knowledge that the tenants gave to the landlord on 12 February 2024. The reason the tenancy had to end was the inability for the tenants to afford the rent.
I find that the tenants owe $1779.96 for the loss of rent due to an ineffective 28- day Notice period given by the tenants.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
I am satisfied that the tenants owe the landlord a total of $6102.82 in rent arrears.
The tenant consents to paying $11.00 for a key that was cut by the landlord.
The bond is to be refunded to the landlord immediately to offset the debt the tenants owe to the landlord for rent arrears.
The landlord has applied for suppression of their name and identifying details. As the landlord has been successful with their application, I will grant suppression.
