[The landlord’s representative] attended the teleconference hearing on behalf of the landlord. The tenant, Ms Aberahama, attended the teleconference hearing for the majority of the hearing. However, towards the end of the hearing, Mr Aberahama said he had to go and take another call and got disconnected. Despite trying his phone number another 3 times after this, there was no response. The hearing continued in his absence, as Mr Aberahama had had an opportunity to answer the claim before he went to take another call, Mr Aberahama chose to leave the hearing, and no new issues were raised after he was disconnected.

The landlord has applied for termination of the tenancy, rent arrears and refund of the application fee.

Mr Aberahama acknowledged that he had not been paying rent and said he refused to do so when there were problems with the property, such as blocked drains, a cracked window, bugs that he had to get sprayed and other issues. He also admitted he had changed the locks without the landlord’s consent, as alleged by the landlord, but said he had changed the locks back to what they originally were the week before the hearing. Mr Aberahama maintained he had not had any time to file a claim of his own as he drives trucks and is on the road a lot.

The landlord provided copies of photographs sent to them by the tenant, where he alleged there were bugs at the property. The landlord said they had been around to visit the property to check for bugs, but there had only been carpet threads and fluff, which is what was shown in the photographs provided by the tenant. They have been unable to discover any bugs at the property, despite attempting to follow up with the tenant about it for a while. The landlord said further the tenant had not communicated with them about changing the locks or changing them back. In any event, the tenant had not filed any claim in this regard. The last rent payment made by the tenant was on 22 February 2024, 10 weeks before the hearing.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).

The landlord provided rent records which prove the amount owing to 30 April 2024, which is $4,620.00. The landlord said no payments have been made by the tenant since then. Weekly rent is $490.00 so daily rent is $70.00. A further 9 days’ rent @ $70.00/day is payable from 1 May 2024 to 9 May 2024, for a sub- total of $630.00. Therefore, the tenant owes the landlord a total of $5,250.00 in rent to 9 May 2024, which is the end of the tenancy.

Because [The landlord/s] has been successful with the claim I must reimburse the filing fee.

The landlord requested name suppression. The tenant did not request name suppression. As the landlord has been successful with the claim, they are entitled to name suppression. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published. See section 95A(1) RTA.
