The tenant rented premises from the landlord in September 2023.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord advised that rent arrears of $3500.00 are owed to the end of the current rent week being 9 May 2024. The tenant agreed with the rent arrears and termination sought and stated that she will return the keys on the morning of Friday 10 May 2024.

The bond is refunded to the landlord to reduce the tenant debt.

The tenant stated that she accepts full responsibility for payment of the debt and proposed repaying the balance of the debt by fortnightly payments of $100.00 commencing Thursday 9 May 2024. The landlord accepted this payment plan.

The tenant’s father is named as a guarantor on the tenancy agreement. He was not able to attend today for health reasons but sent a message stating that he understood he would be removed as a guarantor after 6 months which he calculated to be 16 March 2024.
