Both parties attended the hearing.
The landlord has applied for rent arrears and has provided rent records to support her application. She seeks rent to 21 March 2024, a total of (now) $2,000. Originally, she sought $2,100.00 then $2,050.00.
The tenancy started on 8 February 2024. The tenant spent 1 night at the premises and then left. She states that her friend told the landlord the following day (on 9 February 2024) that the tenant had left.
The reasons the tenant gave for leaving were somewhat vague. Essentially, she did not like the behaviour of the other tenants.
The landlord claims that the tenant only told her on 20 February 2024 she had left the tenancy. She seeks rent owing to that date and 28 days’ rent in lieu of notice.
This was a room-by-room tenancy. Often tenancies of that nature are problematic. With this landlord they are frequently problematic. Little regard is apparently given for the mix of tenants who will share the house with the arrangements often breaking down.
Both parties today referred to what others had told them, yet neither had any witnesses attend to give evidence.
The landlord’s evidence was at times bizarre, so much so that I will not record it here.
I do not accept the tenant’s evidence that the tenancy was misrepresented to her. If the other tenants’ behaviour concerned her, she had remedies available to her. But simply leaving the tenancy does not relieve her of her obligation to give proper notice. She is therefore liable for rent in lieu of notice.
I find it probable that the landlord became aware on 9 February 2024 that the tenant had left the tenancy after just one night. On that basis the tenant is liable for 29 day’s rent – the day she stayed at the premises and 28 days’ in lieu of notice.
I therefore award the landlord $1,470.44 for 29 days’ rent (one day plus 28 days) as well as the filing fee.
The landlord sought, and is entitled to, name suppression as the application is mostly successful. The tenant is not entitled to name suppression as her defence was not successful – see section 95A of the Residential Tenancies Act 1986.
