Reasons

The landlord and both tenants attended the hearing in person today.

The landlord has applied for termination of the tenancy and for payment of rent arrears and the costs of carpet cleaning.

This tenancy started on 12 October 2021 and the rent records show mostly consistent payments of rent. Any missed rent has been caught up quickly in the past.

The tenants explained that one of them has become very unwell recently and the need to attend many medical appointments has meant that neither of them have been able to work their usual hours. The lower income and difficult circumstances have led to the rent not being paid and them not communicating with the landlord.

The landlord’s rent records prove that the rent is now eight weeks in arrears.

Should a conditional termination order be made?

Where rent is at least 21 days behind on the date of the hearing, the Tribunal must make either a final or a conditional termination order. See section 56(2) and 55(1A) Residential Tenancies Act 1986.

A conditional termination order means that the tenants are given the opportunity to repay the debt instead of terminating the tenancy immediately.

The tenants are now seeking help with their situation.

After hearing the evidence, I am satisfied the tenants will make their best efforts to pay the debt within the period specified in the order and are unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenants breach the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Carpet cleaning

The carpet has stains in some places which need to be treated soon to try to avoid these becoming permanent. The tenants agree to pay the costs for stain treatment ($150.00) and carpet cleaning ($180.00). We talked about ways to avoid more stains in the future. Ongoing cleaning and maintenance

The best way to avoid bigger costs or problems is for tenants and landlords to communicate openly with each other.

The landlord will arrange to have the dishwasher checked to make sure there is no ongoing leak or water damage. The tenants must make sure to tell the landlord whenever they notice a water leak or any other problem or damage at the house. This is so that the landlord can make sure that it doesn’t get worse. The landlord has succeeded with the application so is entitled to be reimbursed for the filing fee and to suppression of name.

I also suppress the tenants’ names on this occasion. The medical circumstances and the tenants’ past record of paying rent consistently and catching up quickly when needed outweighs the public interest. It is so important to always talk to and work with the landlord if it is hard to pay the rent because then a repayment agreement can be made without having to go to a Tribunal hearing.
