Both parties attended the hearing. Ms Perese appeared on behalf of the landlord.

This matter was conducted by way of rehearing as the tenant had not received the notice of hearing for the original hearing held in this matter.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The landlord has provided rent records proving the amount owing.

The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986 (“RTA”).

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. The tenant has already been paying an additional $20.00 per week towards the arrears since 28 August 2024.

I have granted a conditional termination order with the agreement of both parties.

Ms Perese advised at the hearing that the tenant’s rent is set by the Ministry of Social Development and can be adjusted up or down depending on the tenant’s income and/or benefit status. I have therefore included an order that provides that the amount of weekly rent may increase or decrease but the payment of $20.00 for the debt will continue.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) RTA.

At the hearing I explained to [The Tenant] that she needs to ensure that payments are made on time as if she fails to keep up payments as ordered the tenancy will terminate. She has confirmed that she will keep in contact with the landlord and advise immediately if there are likely to be any issues making the payments as ordered. Filing fee and name suppression

The landlord did not seek reimbursement of the filing fee.

As this order has been made by consent I do not consider that there is any public interest in publication of the tenant’s name and make an order suppressing the tenant’s name pursuant to section 95A RTA. Amendments made on 6 November 2024

The landlord did not seek reimbursement of the filing fee for filing this application in the Tribunal but the original order issued on 4 November 2024 contained two references to the “filing fee”.

For the sake of clarify I have amended the order to remove the references to the filing fee.
