Chrissy Pratt must pay rent and the debt as follows: a. By weekly payments of $420.00, being rent. Payments will be every Monday, with the first payment on 13/05/2024 and continuing every Monday thereafter until the debt is paid. b. A final payment of $2,844.57, being the debt, no later than Friday 31 May 2024.

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If the tenant fails to pay rent and rent arrears within 3 working days of the due dates: a. The tenancy at 33 Cole Street, Dannevirke, Dannevirke 4930 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant fails to pay the filing fee within 3 working days of the due date, the filing fee will be payable immediately.

Both parties attended the hearing, conducted via video/phone conference

The landlord had applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

The tenant has resurfaced after a long unnotified absence and is now back at the premises. The landlord varied the application to seek termination for rent arrears. Rent as at the date of the application is more than 21 days in arrears and has increased since that date.

The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

I accept the variation in application and s 55(1) Residential Tenancies Act 1986 applies.

Despite the arrears being such that termination should be ordered, I have considered s 55(1A) RTA. Having heard the evidence, I am satisfied the tenant should be given a final opportunity to pay the debt within the period specified in the order. She is unlikely to commit any further breach now that agency payment of rent has recommenced. I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.

Paying the debt will more than likely require agency assistance. It is for the tenant is pursue such assistance as necessary, for the reasons she stated at the hearing.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Application filing fee

Because For Homes (NZ) Limited has wholly succeeded with the claim I must reimburse the filing fee.
