The tenant must fix the holes in the walls by Monday 9 th December 2024.

Reasons

The landlord attended the hearing on 4 th November 2024. The tenant did not.
This was a part-heard hearing from 31 st July 2024.
The landlord had applied for termination of the tenancy for breach of the tenant’s obligations.
At the last hearing, I declined the landlord’s application for termination based on 2 window glass panes that had been broken by the tenant’s daughter.
The landlord also sought to terminate the tenancy on anti-social behaviour notices. However, as this is a fixed-term tenancy, the tenancy could not be terminated on 3 anti-social notices being issued.
The landlord raised issues regarding blocked sewage pipes at the hearing. The hearing was adjourned for the tenant to respond.
The landlord presented evidence of the wastewater pump being blocked with wet wipes and fibrous material. There were 2 incidents with 2 invoices dated 15 th July 2024 and 25t October 2024. I find that the blockage was caused by the tenant’s carless use but I do not find that it warrants any termination. However, the tenant needs to pay for the two invoices.
There were some holes in the walls on the premises from the photos with a quote of $1.725.00 for interior painting of 4 walls and ceiling, hole fixing and plastering. If the tenant does not fix the holes in the walls within 28 days, this is what the tenant can be liable to pay the landlord at a later date. However, I do not award this amount as an alternative yet.
The tenant was not in any arrears for rent but had $206.25 in water rates arrears. I order the tenant to pay this amount immediately.
As the damage to the ranch slider was caused intentionally by the tenant’s daughter, the tenant is liable to pay for the two ranch slider glass repairs.
I do not find the tenant has breached her responsibility to the extent that requires the tenancy to be terminated.
I order the tenant to pay the landlord the amount ordered above as compensation.
Furthermore, I order the tenant to fix the holes in the walls within 28 days.
The landlord had sought work orders for pavement and the carpet. I do not find that the damage was caused intentionally or carelessly by the tenant.
