The tenant stopped paying rent on 9 April 2024. The landlord advised that it remained in contact during that month but that the tenant stopped replying.

On 21 May 2024 the landlord emailed the tenant notice of a routine inspection to take place on 24 May 2024. The landlord provided the Tribunal with a copy of the report undertaken on that date and gave evidence that the tenant appeared to have drawn all of the curtains, taken anything of value, clothing, personal possessions and bedding, and left behind a considerable quantity of rubbish and damaged chattels. The photographs in the report supported this.

The landlord’s opinion is that the tenant, being by that time in rent arrears of $2,649.00, abandoned the property having received notice of the inspection.

Given the nature of the items missing from the property and the condition in which it was left, the landlord has satisfied the Tribunal on the balance of probabilities that the tenant has left the property without any intention of returning.

On 24 May 2024, being the date of the inspection, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
