Reasons

Mr W, representing the landlord, attended the hearing together with the owner. The tenants did not attend.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The tenancy commenced on 20 October 2023 and was to end on 19 October 2024. Rent arrears began to arise in the middle of 2024 and at the request of the tenants the Landlord agreed to a reassignment of the tenancy.
In any case where a fixed term tenancy is reassigned the previous tenant is liable for rent to the date of re-tenanting or the sooner ending of the fixed term tenancy. The tenancy was vacated on 27 May 2024 and the premises were retenanted on 20 June 2024.

How much is owed for rent?

The landlord provided rent records which prove the amount owing to the date the premises were re-tenanted. Recovery of expenses incurred by the landlord
To be successful in a claim for recovery of expenses incurred in respect of assignment a landlord must provide an itemised account. See section 44A Residential Tenancies Act 1986
The landlord did provide an itemised account to support the claim and I accept all except one item met the standard that the expenses were reasonably incurred in the re-letting process.
The landlord also seeks to claim $113.84, the costs of the methamphetamine screening test. The owner explained that this was a requirement of his insurance company and that if the tenancy hadn’t ended earlier than anticipated he would not have had to incur this cost. The landlord submitted that this was a cost that was reasonably incurred in the process of reletting.
After having considered the submissions from the landlord and the owner I dismiss the claim for the costs of the testing. The requirement for testing was part of the contract that the owner had with the insurance company and should not be a cost that the tenants incurred. While I accept that this cost was incurred earlier than the owner expected, this would have been a cost incurred had the tenancy ended as originally planned in order to comply with the requirement of his contract with the insurance company.
Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee and grant suppression of the landlord’s name and identifying details as requested.
