Reasons

Ms Watson attended the hearing for the landlord. The tenant did not attend.
The landlord applied to terminate the tenancy on the basis that the tenant, Mr Farrell, assaulted and/or threatened to assault a neighbour of the tenancy premises, Mr Stringer. The landlord also applied for a rent arrears order and payment of the bond.

Should the tenancy be terminated?

The relevant law is found in section 55(1)(c) of the Residential Tenancies Act 1986 (the Act). That section provides that the Tribunal must make an order terminating the tenancy if the Tribunal is satisfied that the tenant caused or permitted any person to assault, or threatened to assault, any neighbour of the premises.
The landlord claims that in the early hours of 24 May 2024, Mr Farrell pointed what appeared to be a gun at Mr Stringer, threatened to kill him, and hit him on the shoulder with the gun. The incident was recorded on CCTV (a copy of the recording was provided in evidence) and witnessed on the CCTV monitor by a staff member of the landlord. Both the staff member and Mr Stringer phoned the Police and Mr Farrell was subsequently charged with three offences in relation to the incident including threatening to kill and assault. The landlord’s evidence was supported by written statements from Mr Stringer and the staff member, and by an email from the Police.
I am satisfied that the criteria in section 55(1)(c) of the Act has been established. This means that I am required to make an order terminating the tenancy.

The landlord provided rent records which prove the amount owing at the end of the tenancy.
The landlord has been successful in its claims and is therefore entitled to payment of the Tribunal application fee.
