Only the applicant landlord attended the hearing which took place by teleconference. The tenant was called on the number provided three times, but the calls went to voicemail. The hearing proceeded in the tenant’s absence.
This tenancy ended on 8 July 2024.
On 8 August 2024 the Tribunal ordered rent and water arrears, refund of the bond and reimbursement of the filing fee. The Adjudicator amended the claim to include claims for vacated costs and the proceedings were adjourned to today’s date to consider these claims.

The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish. A copy of the exit inspection report dated 9 July 2024 with photographs was provided. The amount of $630.00 for a skip bin and labour is ordered for rubbish removal, this is the GST exclusive amount as the full amount sought will not be ordered due to only a quotation being provided. The landlord confirmed that the work had been done.
An invoice for cleaning was provided from Life Maid Easy. Reimbursement of this invoice is ordered minus the cost of window cleaning. The tenant is ordered to pay $1161.50 for cleaning.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
Where the damage is careless and is not covered by the landlord's insurance, the tenant's liability is limited to four weeks' rent (or market rent). See section 49B(3)(b) RTA. Where insurance money is irrecoverable because of the tenant's conduct, the property is treated as if it is not insured against the damage. See section 49B(3A)(a) RTA.
