Reasons

This application was scheduled to be heard by video conference. The tenants did not appear via the teams video link and both times I called each of their telephone numbers my calls went to voicemail. The hearing proceeded in their absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, reimbursement of the filing fee and payment of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 21 May 2024 the landlord became aware that the tenants had abandoned the premises. The landlord had visited the premises on that day because the rent had gone into arrears and she had been unable to contact the tenants. When she arrived at the premises she noticed that the interior of the house was largely empty.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much do the tenants owe?

When tenants abandon fixed term tenancies they are liable for rent up until the end of the fixed term (in this case 1 December 2024) or the date on which a new tenancy begins at the premises, whichever is the earlier.
There is no new tenancy as yet and as at today’s date the rent record shows that there is $3050.00 in rent arrears.
Further to this, I am ordering the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful in their claim.
