Tristan Buckner and Carol Buckner must pay [The landlord/s] $3,100.44 immediately, being rent arrears to 23 July 2024 and reimbursement of the filing fee, calculated as shown in the table below:

Reasons

An employee of the landlord attended the hearing as representative for the landlord. The tenant’s mother, who was named in the application as a joint tenant (see below) contacted the Tribunal on the day of the hearing shortly before the hearing was about to start and requested an adjournment. The tenant was advised (via his mother) that the request for an adjournment was dismissed but that the tenant could attend by telephone, send a representative and/or provide the tenant’s response to the claim in writing. The tenant did not attend the hearing and the hearing proceeded in his absence.
The tenancy agreement does not record the landlord as the landlord. However, the landlord has provided a Rental Management Agreement showing that it is the Agent for the landlord.
The tenancy agreement records the tenant and a Ms Overton as the tenants. Prior to the hearing, the landlord advised the Court Registry Office that Ms Overton was no longer residing at the premises and did not need to be included in these proceedings. The landlord has listed the tenant and his mother as joint tenants. However, no paperwork has been provided to the Tribunal to evidence that the tenant’s mother has entered into a tenancy agreement with the landlord. In addition, letters sent from the landlord to the tenant on 28 May 2024, 11 June 2024 and 19 June 2024 regarding rent arrears are addressed to the tenant. For these reason, the tenant’s mother’s name has been removed from these proceedings.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
During the hearing, the landlord was asked for the bond number. This was provided after the hearing. The Tribunal’s records show that the bond has been refunded. If either party believes this is incorrect, they should contact the Bond Centre.
