The landlord appeared. There was no appearance by the tenant.
The tenancy commenced on 23 February 2015. On 12 September 2022, there was a rent increase from $415.00 to $495.00 per week. On 20 June 2024, the landlord issued another rent increase from $495.00 to $580.00 per week effective 22 August 2024.
On 09 July 2024, the landlord filed an application to terminate the tenancy for rent arrears of more than 21 days. The application was scheduled for hearing on 01 August 2024. On that date, the landlord appeared., but the tenant did not. The application was adjourned to allow the landlord to provide updated rent records.
Based on the evidence, I am satisfied that the rent was at least 21 days in arrears when the application was filed on 09 July 2024. Therefore, the tenancy is terminated, and possession is granted to the landlord at midnight on Sunday 15 September 2024. See section 55(1)(a) of the Residential tenancies Act 1986 (The “Act”)
The landlord has also issued several 14-day breach notices to remedy rent arrears, which have not been remedied. As at the end of the tenancy the rent remains more than 21 days in arrears. The Tribunal notes that the tenant has failed to adjust their rent payments to meet either of the increases.
Rent arrears are awarded to the end of the tenancy.
The bond is refunded to the landlord. The landlord will enforce the balance owing. Costs
