Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenant agreed to the tenancy ending and stated that he is in the process of moving out. The parties agreed to the tenancy ending on Monday 7 October 2024. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The tenancy agreement names one tenant, Bruce Sagadevan, under the heading “Tenant Details” and only contains his service and contact details. However, there are two tenant signatures and [Tenant 2] appears to have signed the agreement.
The landlord has only named Bruce Sagadevan as a party to these proceedings and only sought an order against him today. Therefore, an order can only be made against Bruce Sagadevan today.
The tenant did not dispute the rent arrears but stated that he wishes to make a claim against [Tenant 2] whom he stated shared the premises with him until June 2024. The Tenancy Tribunal does not have jurisdiction to consider disputes between tenants or flatmates. If Mr Sagadevan wishes to pursue this, he may file a claim in another jurisdiction.
Because the landlord has wholly succeeded with the claim I must reimburse the filing fee and suppress the landlord’s identifying details as sought.
