The tenant was liable for rent to the end of the fixed term or the earlier reletting of the premises. New tenants moved in on 25 July 2024. I find that the landlord is entitled to rent in the sum of $2,792.86 to 24 July 2024.

The landlord provided rent records and water invoices which prove the amount owing at the end of the tenancy. Cleaning and Rubbish Removal

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.

The tenant did not leave the premises reasonably clean and tidy in some respects and did not remove all rubbish. The overall condition of the premises was reasonable, however, there was some need for cleaning in the kitchen, to the cupboards and the oven. I award the cleaning costs claimed ($400.00 plus GST).

The landlord’s photographs show the tenant left behind furniture and external rubbish. This included some large objects such as pallets. I award the removal costs claimed ($700.00 plus GST). Repairs

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or 4 weeks' rent. The excess was $500.00, and the weekly rent was $850.00.

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.

There were several holes in the walls of bedroom 3, and the window in that room was broken. An internal door was missing a handle. The kitchen tap had been forcefully twisted and was broken. There was a hinge missing from the door of a kitchen cabinet. The clothesline frame was still attached to the exterior cladding, but the individual lines were broken or missing. Part of the toilet-roll holders in the bathrooms were missing so that they could not be used.

The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. Bond

I have directed the Bond Centre to pay the bond of $3,400.00 to the landlord. Filing Fee and Name Suppression
