The tenancy commenced on 13 March 2023 and was periodic. The parties to the agreement were the landlord, [Previous tenant 1], and [Previous tenant 2]. On 18 January 2024, there was a transfer of agreement from [Previous tenant 1] to Ngakorowai Tihore who joined [Previous tenant 2]. At the time of the transfer, the rent was up to date. On or about 06 February 2024, [Previous tenant 2] advised the landlord that they were no longer residing at the property. [The landlord’s representative] states that from mid-June 2024, the landlord considered [Previous tenant 2] to be released from the tenancy leaving Ngakorowai Tihore as the sole tenant. On that basis, [Previous tenant 2] is not named as a party. The application filed on 03 July 2024, names Ngakorowai Tihore and [Previous tenant 1] as joint parties. However, as stated [Previous tenant 1] was released from the tenancy on 18 January 2024. [The landlord’s representative] accepts that naming her has been an error and accordingly, the Tribunal removes [Previous tenant 1] as a party.

The landlord has produced an up to date rent summary. 21 days or three weeks rent is $1,740.00. I am satisfied that the rent was at least 21 days in arrears on the date the application was filed on 03 July 2024. The tenancy is terminated, and possession granted to the landlord at midnight on Thursday 01 August 2024. See section 55(1)(a) Residential Tenancies Act 1986 (The “Act”).

The landlord provided rent records which prove the amount owing at the end of the tenancy.

The landlord’s application also included a claim for a broken window. No evidence has been produced, and the claim is withdrawn. Costs
