Jenna Muru owes Twin Rivers Real Estate Limited As Agent For Mclaren Partnership $2,462.00 (“the debt”) as set out below:
Jenna Muru must pay rent and the debt as follows: a. By lump sum payment of $2,240.00 by Monday 12/08/2024. b. By 2 weekly payments of $665.00, being $565.00 for rent and $100.00 for the debt. c. A final payment of $587.00, being $565.00 for rent and $22.00 for the debt. d. Payments will be every Monday, with the first payment on 12/08/2024 and continuing until 26/08/2024.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 10 McDiarmid Crescent, Huntly, Huntly 3700 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the video hearing.
The landlord’s agent has applied for termination of the tenancy, rent arrears and refund of the bond. However, at the hearing, the landlord’s agent advised arrangements have been made for a substantial part of the arrears to be repaid shortly. The parties agreed to a schedule of repayments for the remainder of the debt to be paid off in order to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
At the outset of the hearing, the landlord advised the parties had been in contact with Work and Income New Zealand (WINZ) and WINZ had indicated it would pay the landlord’s agent $2,240.00 today as partial payment of the tenant’s rent arrears and this week’s rent. Given that, the landlord’s agent proposed the remainder of the debt could be paid off by weekly instalments of $100.00 until the debt is cleared.
The tenant confirmed the proposal was accepted by her. I have therefore granted a conditional termination order on those terms.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
As Twin Rivers Real Estate Limited As Agent For Mclaren Partnership has succeeded with the claim the tenant must reimburse the filing fee.
