Kristy Haronga must pay rent and the debt as follows: a. Commencing on Thursday, 19 September 2024, by 4 weekly payments of $670.00, being $595.00 for rent and $75.00 for the debt; b. Commending on Thursday, 17 October 2024, by 91 weekly payments of $695.00, being $595.00 for rent and $100.00 for the debt; c. A final payment of $655.43, being $595.00 for rent and $60.43 for the debt; d. Payments will be every Thursday, with the first payment on Thursday, 19 September 2024 and continuing until Thursday, 23 July 2024.

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 12 Edwin Freeman Place, Ranui, Auckland 0612 will terminate and the landlord will have immediate possession of the premises; and b. The balance of the debt will be payable immediately.

If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing which is a rehearing of a matter which was initially heard on 23 July 2024.

The landlord applied for termination of the tenancy, rent arrears and refund of the bond. On 23 July 2024, the Tribunal made a conditional termination order and an order for rent arrears and reimbursement of the filing fee.

The tenant applied for and was granted a rehearing on the grounds that the rent ledger provided by the landlord at the original hearing had missed 3 payments.

The tenant wishes to repay the debt to avoid immediate termination.

What is the amount of the rent arrears?

The landlord provided an updated rent ledger showing the amount of rental arrears. The tenant was provided a copy of this document. The tenant agreed that the figure was correct.

The claim for rent arrears is proved.

Should a conditional termination order be made?

Sections 55(1)(a) and (1A) of the Residential Tenancies Act 1986 (RTA) provide that where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order.

Rent is at least 21 days in arrears on the date the application was filed.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. (See section 64(4)(b) of the RTA.)

The landlord has wholly succeeded with the claim. Therefore, I must order reimbursement of the filing fee.
