Reasons

Ms Wanoa attended the teleconference hearing on behalf of the landlord. [The tenant/s], the tenant, also attended the teleconference hearing.

The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee.

The tenant said she lost her job on 28 June 2024 and that it took her 6 weeks to find another job. She indicated her new job is in [town] and she has been staying there, but her mother still lives at the tenancy property in Wairoa. The tenant did not wish to stay at the property but wanted time to move out. The landlord pointed out that, other than a payment for $520.00 on 12 September 2024, the tenant had not paid any rent since 17 July 2024 and that this had put the owner in a very tough financial position. The landlord wanted immediate termination of the tenancy.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).

The landlord provided rent records which prove the amount owing to 2 October 2024, the day before the hearing, which is $4,971.42. The tenant agreed she owes this amount to 2 October 2024. Weekly rent is $470.00 so daily rent is $67.14. A further 5 days’ rent @ $67.14/day is payable from 3 October 2024 to 7 October 2024, for a sub-total of $335.70. Therefore, the tenant owes the landlord a total of $5,307.12 in rent to 7 October 2024, which is the end of the tenancy. Filing fee

Because Property Brokers Hawkes Bay Limited has been successful with the claim I must reimburse the filing fee. Suppression

Section 95A(4) RTA provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, having regard to the interests of the parties and to the public interest, order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published.

The tenant acknowledged she owes rent arrears and said she is willing to pay the rent arrears, as she can. The tenant lost her job, which put her into a difficult financial position and then found employment in another area. She has attempted to juggle paying rent in two different places to allow her mother to remain in the property, without success. This has been a difficult situation for both the tenant and the landlord. In the circumstances and given the evidence, I find the tenant’s interests outweigh the public interest in publishing her name. Therefore, I order that the tenant’s name and identifying details are not to be published.
