Joelle Nafisa Awiyele, Precious Musau Awiyele and Henri Motuke Ligimba must pay [The landlord/s] $914.14 immediately, being rent arrears to 16 October 2024.
The tenant must pay the debt of $914.14 at the rate of $50.00 per week.
The first payment must be made on Tuesday 22 October 2024 and payments must continue every Tuesday until the debt is paid in full.
If the tenant fails to make any payment within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.

Reasons

Both parties attended the hearing by telephone.
The landlord has applied for rent arrears. The application for water rates was withdrawn at the hearing.
The issue is whether the premises were in a reasonably clean and tidy condition at the commencement of the tenancy.
The tenant says that they were advised that work would be carried out before commencement of the tenancy including installing new carpet, replacing lightbulbs, cleaning and painting. The tenancy was to commence on 21 June 2024, but the tenant said that the only work that had been carried out was replacement of the carpet.
At the hearing the landlord advised that some work had been carried out after the date that the tenancy was to commence. Most of the work was carried out by 4 July 2024.
The tenant wanted the interior commercially cleaned as there had been a sick person living in the premises previously. The landlord produced a video showing a wall where the top layer of wallpaper had been removed and there was dirt clear on the remaining layer of the wallpaper.
The tenant arranged for the premises to be cleaned on 13 July 2024 and it was only after this that the tenant agreed to move into the premises.
On the evidence, while the tenancy agreement records that the tenancy commenced on 21 June 2024, I consider that the premises were not ready for the tenant to move in. I note that she says that other matters remain unresolved four months later.
For this application I determine the start date of the tenancy as being 13 July 2024. The rent arrears are ordered from that date.
The tenant has agreed to pay the debt at $50.00 per week.
Because [The applicant/s] has substantially succeeded with the claim I have reimbursed the filing fee. For the same reason I suppress the landlord’s name.
