Reasons

This claim was scheduled to be heard at 9.30am today by video conference. The tenants did not link in to the Teams link provided and so I rang their mobile numbers. The number provided for Ms Kaur did not go through.
I left a message on Mr Singh’s voicemail and advised him that I would ring again in 5 minutes. Mr Singh answered my second call and advised that he was unable to attend the hearing because he was driving. He requested that the hearing be adjourned. I told him that he had been given notice of the hearing well in advance and that the hearing would proceed whether he elected to attend by phone or not. Mr Singh them hung up the phone and when called again did not answer. The hearing proceeded in the tenants’ absence.
This order ought to be read together with the Tribunal’s previous order dated 28 August 2024. I adjourned the hearing on that day to allow both parties an opportunity to provide evidence to support their positions.
The tenants did not provide any further evidence.
On the evidence available to me, then, I accept that the tenants signed a 6 month fixed term tenancy due to start on 20 July 2024. The tenants did not move in and so the landlords have applied for rent arrears up until the date a new tenancy started, as is their right under the Residential Tenancies Act 1986.
I accept the evidence that a new tenancy started on 6 August 2024 and so Mr Singh and Ms Kaur owe rent from 20 July 2024 to 5 August 2024. This amounts to $1,748.57.
The tenants are also required to pay a break lease fee which must be reasonable. Having heard from the landlord that they conducted 10 viewings and did 6 credit checks, after having advertised the property, I accept that a &720.00 break lease fee is reasonable.
Further to this, the tenants are required to reimburse the filing fee to the landlord because the landlord was wholly successful in the claim against them. C ter Haar 30 October 2024
