The landlord has applied for payment of rent owing and compensation for end of tenancy costs and repairs.

This was a two-and-a-half-year tenancy. The tenancy ended on 21 June 2024 after the tenants’ gave notice.
The property management company changed during the tenancy. The landlord has provided rent records from both companies. These were discussed during the hearing and the tenants now accept that there is an amount of $1,225.71 remaining to be paid up to the end date. End of tenancy costs
At the end of a tenancy, the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all landlord chattels. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
The tenants accept that there were two doorstops and one front door key missing at the end of the tenancy. The landlord did not have receipts for these items however I award $10.29 per doorstop, plus $15.00 landlord labour, and $10.00 to cut a key because the amounts claimed are small.
I do not award the claim to replace a tv mounting bracket as no receipt was supplied and the claim is for a larger amount. Receipts are expected in the Tribunal.
I do not award the claim to replace 7 lightbulbs because I accept the tenants’ oral evidence that not all lights were working at the start of the tenancy.
The tenants agree to the claim for carpet cleaning, and I award the invoiced amount.
The tenants accept they left a small metal-frame, compost box outside. I accept the landlord’s decision to have this removed as the photo shows it is not of high quality. A few items of rubbish or unwanted belongings were also left. I award the invoiced cost to remove. Repairs
If making a claim for damage, a landlord must first prove that any damage happened during this tenancy and is more than fair wear and tear. Fair wear and tear is anything that would happen as a normal and ordinary part of living in the property.
If a landlord proves their part, a tenant must then prove that any damage is not careless or intentional. Tenants are liable for the actions of people at the premises with their permission. Sections 40(2)(a), 41 and 49B RTA.
The Tribunal will sometimes accept quotes for any claimed loss instead of invoices and receipts, but it is relevant to ask whether the cost will actually be incurred.
Scratch damage to the front of one kitchen drawer: The landlord proved that the melamine surface of a kitchen drawer was scratched during the tenancy. The tenants explained that the scratches were caused by the screws on the back of the cupboard handle next to the drawer rubbing on the drawer front. It is possible, with extra care, to close the cupboard without connecting with the drawer. My decision is that the damage is partly caused by the design of the cupboard and partly careless. The damage has not yet been repaired as the landlord says the repairer is not yet available. A quote of $391.00 was provided. Compensation needs to be reasonable taking into account the extent of the damage. I award $100.00 towards the loss in value and taking into account that part of the cause is the design of the cupboard.
Plaster and paint patches on walls and one door: The tenants accept that one internal door was damaged during the tenancy and that they patched several small holes and patch-painted these and other bumps and scrapes. Unfortunately, the plaster finish was not smooth, and the paint did not match. This is seen as careless damage. The invoiced amount is reasonable for the work done and is awarded. Filing fee, bond, suppression
The landlord has substantially succeeded with the claims so is entitled to the filing fee and suppression of name.
