Reasons

Only the landlord, represented by Ms Jasmine Grey, attended the hearing, which was conducted via teleconference. Three attempts were made to contact the tenant, and on each occasion, the call was unanswered. The hearing proceeded in her absence.
The landlord has applied for termination of the tenancy and rent arrears. The bond is not sought.
At the hearing, the landlord explained the steps taken to address the rent arrears with the tenant, noting that a repayment plan was in place. The landlord hopes to continue working with the tenant to clear the arrears, but in the meantime, has had to seek immediate termination, since the tenant was not present at the hearing.

Should the tenancy be terminated?

I am satisfied that the landlord has established the grounds for termination of the tenancy. Rent was at least 21 days in arrears on the date the application was filed. At the date of the hearing, rent was well over 21 days in arrears. The landlord provided rent records and oral evidence in support.
Accordingly, the tenancy is terminated under section 55(1)(a) of the Residential Tenancies Act 1986.
The landlord’s rent records prove the amount owing at the end of the tenancy. Filing fee and name suppression
The landlord does not seek the filing fee.
The landlord has requested name suppression for the tenant. While noting that the tenant is the unsuccessful party, having had regard to the interests of the parties and to the public interest, and with the landlord’s consent, the Tribunal orders suppression of the tenant’s name and identifying details.
