Reasons

This application was scheduled to be heard by teleconference. I rang the number provided for the tenant and left a message when my call went to voicemail saying that I would be ringing again in 5 minutes. My second call also went to voicemail and so I proceeded with the hearing in the tenant’s absence.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by removing the smoke alarm on more than one occasion, keeping a dog at the premises in breach of his tenancy agreement, carelessly causing damage to the premises and not keeping it reasonably clean.

The landlord served 14-day notices on the tenant on 1 July 2024, 7 August 2024 and 26 August 2024. I accept the evidence that the tenant did not remedy the breaches within the required period. I also accept that these issues have still not been remedied.

It would be inequitable to refuse to terminate the tenancy because removing a smoke alarm can have very serious consequences, particularly because these premises form part of a complex of units. I note too that in June of 2024 the tenant acknowledged that he had had a fire on the stove.

Keeping a dog on the premises is also a significant breach of the tenancy agreement because the evidence indicates that the dog is causing damage and is often left locked inside the premises.

I am also ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful in their claim against him. C ter Haar 10 October 2024
