This application was scheduled to be heard remotely. I rang the number provided for the tenant twice and neither of my calls went through. The hearing proceeded in her absence.

This order ought to be read in conjunction with the Tribunal’s previous order for application 4962294 dated 23 August 2024 in which the Tribunal made an order against the tenant leaving an amount of $956.24 in the Bond Centre for later distribution. Compensation

The tenant’s obligation is to leave he premises reasonably clean and tidy and to remove all rubbish.

The tenant is also obliged to pay for the cost of repairing or remedying damage that was caused carelessly or intentionally during the tenancy and which is beyond far wear and tear.

One of the invoices presented to the Tribunal was for $3,668.50. This invoice was for cleaning, rubbish removal, replacement of the bathroom window glass and replacing an aluminium latch.

The photographs show that the premises were left in an egregious condition. There was a significant amount of rubbish left both inside and outside the premises and it was obvious that there had been no attempt to clean.

The photographs also show that the bathroom window was broken and as was a window latch.

I accept that the tenant ought to pay this invoice in its entirety.

A further invoice was for $736.00. This was for replacing the garage window glass, installing a toilet roll holder, repairing a back door lock and repairing kitchen drawers.

I am not allowing the repair of the back door lock because the tenant was required to pay the cost of key and lock replacement ($536.50) in the order for application number 4962294.

I am also not allowing the cost of repairing the kitchen drawers because the photographs show a very dated kitchen and I consider that any damage to them such as broken handles is fair wear and tear.

This invoice was not itemised and so I have had to estimate the cost of replacing the garage window and the toilet roll holder. I have estimated this cost to be $330.00.

The third invoice was for $1,575.50. This was for reinstalling the fence on the left and replacing missing curtains in the lounge and bedroom 2.

As discussed at today’s hearing, I am not allowing the cost of reinstalling the fence. This is because the photograph of the fence shows it to be very old and I consider that any damage was likely fair wear and tear.

In allowing $200.00 as the cost of replacing the missing curtains I have taken into account that the curtains, although some years old, would nevertheless have had some residual value. Filing fee reimbursement
