The landlord attended the hearing by remote teleconference. Attempts were made to contact the tenant on the telephone number provided. These attempts were unsuccessful.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The landlord claims that the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The evidence filed by the landlord does not support the amount claimed. The only evidence provided which indicates that the tenant did not leave the premises reasonably clean and tidy is a photograph of the bathroom vanity with hair on it. I have sighted the cleaning invoice dated 2 September 2024 in support of this claim. I am prepared to allow this claim but reduce the amount to $150.00 to reflect the evidence provided.
The landlord says that the tenant did not return the garage door remote control. I have sighted an invoice from King Kong garage doors dated 3 September 2024 in support of this claim.

The landlord says that the tenant did not leave the carpet reasonably clean and tidy. The carpet was brand new at the start of the tenancy last year. I have sighted photographic evidence which confirms the carpet was not left in an acceptable state. There are visible stains and marks on the carpet which needed to be professionally removed. The landlord has provided an invoice dated 2 September 2024 in support of this claim. The amount claimed is reasonable and allowed.
