Both parties attended the hearing by telephone conference. Mr Bhatnagar joined the call as he is also a tenant but is not recoded on the tenancy agreement. This was confirmed by the landlord.
The landlord has applied for rent arrears, part refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The tenants confirmed that they had filed an application for the refund of their bond.

How much is owed for rent?

The tenancy began on 17 March 2023 and ended on 18 August 2024.The landlord provided rent records which prove the amount owing at the end of the tenancy. The landlord said that the tenants have paid the rent on time but have not paid the rent increase which took effect on 26 April 2024. This has resulted in the tenants being in rent arrears at the end of the tenancy.
The landlord issued a rent increase notice on 26 February 2024, that the rent would increase to $750.00 on 26 April 2024.This is exactly 60 days’ notice.
The tenants agreed that they received the notice but believed that it was only 45 days’ notice. They could not explain to the Tribunal why they believed this and how they calculated it.
The landlord thought the confusion may have come from a notice that was sent to the tenants on 5 June 2024 reminding them that there was going to be a rent increase.
The tenants also stated that they did not pay the rent increase because the landlord had failed to fix things since the tenancy began. At the date of this hearing, they had not filed any further claims with the Tribunal.
At tenant’s responsibilities are to pay rent as and when it is due under the tenancy agreement. See section 40(1), Residential Tenancies Act 1986, RTA. There is no provision to withhold rent payments if the tenant is not satisfied with the maintenance of the premises. The tenants can make an application to the Tribunal to have these claims heard.
Rent arrears are ordered as claimed by the landlord.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
The landlord sought name suppression and as they are successful this is granted. See section 95A,RTA.
