Reasons

The landlord attended the hearing. The tenant did not attend the hearing. The tenant has not communicated with the Tribunal as to why he would not attend the hearing and the hearing proceeded in his absence.

The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

The landlord had also applied for an order giving permission to dispose of the tenant’s property. However, at the hearing, the landlord advised that it was willing to store the tenant’s belongings. The application to dispose of the tenant’s property is withdrawn.

The Tribunal does not have jurisdiction to order (or otherwise give permission) to the landlord to store the tenant’s property. However, I note for the record that the landlord does not require permission from the Tribunal to take this action and I consider the landlord’s proposal to safely store the tenant’s property for the meantime to be a practical and reasonable solution.

As set out above, any personal documents of the tenant should be taken to the nearest Police station and a receipt should be obtained.

Should the tenancy be terminated?

Section 61 of the Residential Tenancies Act 1986 provides that the Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 31 July 2024, the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord become aware because the tenant had stopped paying rent and, upon inquiry, the tenant’s Social Worker advised the landlord that the tenant was no longer residing at the premises.

The premises have been abandoned, and rent is in arrears. For this reason, the tenancy is terminated immediately.

The landlord provided rent records in the form of a rent ledger which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice.
