Wayne Hapi and Robyn Belmont owe [The landlord/s] $430.00 (“the debt”) as follows:
Wayne Hapi and Robyn Belmont must pay rent and the debt by: a. a payment on 22 October 2024 of $595.00 for weekly rent; b. 8 weekly payments of $645.00, being $595.00 for rent and $50.00 for the debt with the first payment on 29/10/2024 and continuing every Tuesday to and including 24/12/2024; c. a final payment of $625.00, being $595.00 for rent and $30.00 for the debt.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat 2, 5 Hall Grove, Ebdentown, Upper Hutt 5018 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord attended the hearing which was held by teleconference. Two unsuccessful attempts were made to phone the tenants on the number specified in the Notice of Hearing, which was properly served.
The landlord has applied for conditional termination of the tenancy, rent arrears and refund of the bond.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
Rent records provided by the landlord show that the rent was more than 21 days in arears when the application was filed.
The arrears have been reduced considerably since then.
It would have been preferable to have been able to make the Order for payment of the arrears with the tenants’ input but in their absence I am satisfied that these repayment arrangements are reasonable and are satisfactory to the landlord. I have granted a conditional termination order accordingly.
The conditional termination order will lapse if it is fully complied with. If the tenants breache the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
