The Bond Centre is to pay the bond of $1,000.00 ([Bond number suppressed]) to [The landlord/s] immediately.
Any goods left by the tenant at the premises must be collected within 7 days of the date of this Order.
Any goods remaining after that time may be dealt with by the landlord by: a. selling the fridge/ freezer by public auction or by private contract at a reasonable market price, and b. disposing of all remaining goods as the landlord sees fit.
The amount owing to the landlord out of the proceeds of any sale is $1,024.14.

Reasons

The landlord attended the hearing which was held by teleconference. The tenant was unable to be contacted in the number specified in the Notice of Hearing, after 2 attempts.
The Notice of Hearing was served on the tenant by e-mail and SMS message, neither of which is given as an address for service in the agreement.
The landlord provided evidence that the e-mail address at which the tenant was served, is the e-mail address through which there has been recent communication between the parties. In terms of s.91B(c), no further service is required.
The landlord has applied for rent arrears, payment of the bond, and reimbursement of the filing fee following the end of the tenancy. Orders are also sought regarding disposal of the tenant’s goods.
Since the tenancy ended there has been discussion between the landlord and the tenant regarding collection of the tenant’s goods from the premises.
The landlord’s evidence is that of those goods, only a fridge/ freezer left there by the tenant may have a value above the cost of storing, transporting and selling them.
In terms of s.62A the tenant has had more than 35 days to collect the goods but I am satisfied she should have a last chance to do so.
If she does not, the landlord must sell the fridge/ freezer at a reasonable market price.
The landlord may deduct any amount owing from the sale proceeds, and must pay any balance to the Bond Centre. See sections 62(3)(b), 62B(2),(3) and (4), 62C(1)(b),(2) and (3) Residential Tenancies Act 1986).
The landlord may dispose of any goods that have no saleable value.
Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
