Reasons

Both parties attended the hearing which was held by teleconference on 29 January 2025.

Under section 40(1)(e)(iii) of the Residential Tenancies Act 1986 (RTA), tenants are obligated to leave the premises reasonably clean and tidy and to remove all rubbish at the end of the tenancy. Failure to meet these obligations may result in the tenant being held liable for costs incurred by the landlord to address these breaches.

The landlord has filed an application seeking reimbursement for rubbish removal costs incurred after the tenancy ended. Initially, the landlord sought to recover costs for rubbish removed from inside the house, the garage, and along the fence line at the back of the property. However, at the hearing, the landlord clarified that the claim had been reduced to cover only the costs of rubbish removal from inside the property and the garage, totalling $2,364.41. The landlord relied on evidence, including ingoing and outgoing property condition reports with accompanying photographs, damage and rent statements, a statement of final account, and an invoice for vacated charges. The cost claimed has been proven.

It was acknowledged during the hearing that the tenant had been making weekly payments of $10 towards the debt since 7 August 2024, with the tenancy having ended on 31 July 2024. The remaining balance outstanding is $2,194.41.

The tenant consented to the landlord’s claim in full and requested to increase the weekly payments to $20 per week. This proposal was accepted by the landlord.

As this matter was resolved by consent between the parties, I find it appropriate to formalise this agreement and order payment of the outstanding debt at the agreed rate of $20 per week until it is paid in full.

Given the consensual resolution, and the sensitive nature of the tenant’s current circumstances, I consider it reasonable to suppress the tenant’s name. I do not consider it would be in the public interest to publish the tenant’s name (section 95A(1) RTA). No suppression order was sought by the landlord.
