Reasons

The landlord attended the hearing, conducted via video. The tenant did not join and a call out was made. The call went unanswered. I was satisfied adequate service had completed and I continued with the hearing after the call went unanswered.

The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 24 September 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. Prior advice from the tenant that she was going overseas with an intention to return did not eventuate. The landlord was advised on 6 September 2024 by inter- departmental notice that the tenant was still overseas. Rent has not been paid since July 2024. An inspection notice was served by the landlord, and an inspection conducted on 24 September 2024. That inspection confirmed earlier observations that the premises appeared unoccupied.

I am satisfied the tenant has had ample opportunity to respond to the landlord and/or return to the premises. In the absence of either, abandonment is the logical conclusion.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
