Reasons

Only the landlord, [The landlord/s], attended the hearing, which was conducted via teleconference. Three attempts were made to contact the tenant, and on each occasion, the call went to voicemail. As the tenant has been notified, the hearing proceeded.
This tenancy began on 20 May 2024. The landlord applied for termination of the tenancy, rent arrears and payment from the bond. Since filing the application, the tenancy has come to an end, after the tenant gave notice. The landlord’s evidence, received after the hearing, shows the tenant notified the landlord via text on 28 October 2024. The landlord states the tenancy ended on 18 November 2024.
While termination of the tenancy is no longer sought, the landlord seeks rent arrears and compensation for carpet cleaning. I have accepted the landlord’s oral request to amend the application to include carpet cleaning costs of $80.00.
The landlord has received the bond of $600.00 from the Bond Centre.

How much is owed for rent?

The landlord is prepared to accept that the tenancy ended on 18 November 2024. The landlord confirmed, in his oral evidence, that the amount due for rent, after deduction of the bond, was $1,100.00. He provided updated rent records after the hearing. I am satisfied, from this evidence, that the amount owing at the end of the tenancy has been established. This is awarded above.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986.
The landlord claims carpet cleaning costs, and has provided photographs of the carpet at the end of the tenancy, the relevant invoice, and evidence to show the carpet was brand new at the start of the tenancy. However, from the two photographs provided, I am unable to conclude that the tenant failed to leave the carpet in a reasonably clean condition. Therefore, the landlord’s claim for carpet cleaning costs is dismissed, as it has not been proven. Filing fee
