Reasons

The landlord attended the hearing by telephone. The Tribunal attempted to call the tenants on cell phone numbers provided in the application, but the calls were unanswered and then disconnected. I am satisfied that the tenants received notice of the hearing and chose not to attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986 (RTA). A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 15 October 2024 (the date of abandonment), the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. Following a telephone call from a neighbour advising that the tenants had vacated the premises, the landlord conducted an inspection of the premises and discovered that most of the tenants’ belongings had been removed, the premises were not secured, and there was damage, as shown in photos produced in evidence.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes 20 days rent in lieu of notice up to and including the date of the hearing. Should the landlord be unable to re- tenant the premises, they may be entitled to claim a further 8 days rent in lieu of notice. The tenants are liable to pay the rent up to and including the date 28 days after the date of abandonment or up to the commencement date of a new tenancy, whichever is the earlier. See section 61(3) RTA.
As the landlord has succeeded with their claim, they are entitled to suppression of their name and identifying details as requested and to reimbursement of the filing fee. K Stirling, 04 November 2024
