Jackson Paul Eruera and Michelle Ee must the debt as follows: a. By one payment of $5,687.02 by 5pm Wednesday 4 December 2024 being $4,974.28 for rent arrears to 3 December 2024 and $685.74 for rent to 9 December 2024 and $27.00 for reimbursement of the landlord’s filing fee.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenant fails to pay rent and rent arrears within 2 working days of the due date: a. The tenancy at 7A Lunn Avenue, Mount Wellington, Auckland 1072 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

The landlord attended the video hearing. The tenant, Mr Eruera attended via phone on behalf of himself and his wife.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
The tenant accepts they are in rent arrears to the amount sought by the landlord. The tenant stated he was in a position to repay the debt immediately.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
