If the tenants fail to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 20 McLeod Road, Weymouth, Auckland 2103 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenants fail to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord attended the hearing represented by Ms Melville.

The tenants did not attend the hearing. All three were telephoned however all calls were allowed to ring out. They had been notified of the hearing by letter and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in their absence.

The landlord has applied for termination of the tenancy on the basis of rent arrears. The landlord has served a 14-day notice for rent arrears on the tenants on 29 November which has not been remedied.

In such a situation the Tribunal can either terminate the tenancy or make a conditional termination order. See section 56(1) RTA.

Ms Melville is willing to come to a payment plan with the tenants however they have not engaged with her or the Tribunal process. Despite this she requests a payment plan with a conditional order in order that the tenants be afforded an opportunity to retain their tenancy.

I consider this appropriate and have made the order as sought.

This is a final opportunity for the tenants to engage with their landlord to address this situation. I urge them to do so. They may pay the debt in line with this order or with greater payments to reduce the debt more quickly. The conditional termination order will lapse when it is fully complied with.

If the tenants breach the order, (i.e. do not make the required minimum payments), the possession order is enforceable by the landlord for 90 days from the first breach. See section 64(4)(b) RTA.

Because New Age Rentals Limited T/As Harcourts As Agent For Kulwinder & Harpreet Singh & Kaur has wholly succeeded with the claim I must reimburse the filing fee.
