The tenancy of Hana-leah TeRoimata Palmer at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 11:59pm, Wednesday 22 January 2024.
The Bond Centre is to pay the bond of $1,800.00 ([Bond number suppressed]) to [The landlord/s] immediately.
Hana-leah TeRoimata Palmer must pay [The landlord/s] $3,569.86 immediately, calculated as shown in the table below:

Reasons

The landlord attended the video hearing. The tenant did not attend. The tenant’s mother had notified the landlord that the tenant was arrested on 3 January 2025 and was in custody (as at 9 January 2025). I attempted to call the tenant on her last known mobile number however it went to voicemail.
The tenant’s mother sent the landlord a text message stating she would remove her daughter’s belongings from the premises by 20 January 2025. The landlord states the keys were returned today (22 January 2025) and the tenant has left the premises (albeit that the landlord indicated there were items left behind).
The landlord has applied for immediate termination of the tenancy, rent arrears and refund of the bond.
The landlord had issued the tenant with two notices advising her she was in breach of the tenancy agreement for failure to pay rent. Those letters were sent via email on 30 October 2024 and 12 November 2024. The tenant failed to remedy the rent arrears within 14 days of either notice.
As at the date of the hearing, rent was at least 21 days in arrears.
Pursuant to s56(2) of the Act, the tenancy is terminated.
The landlord provided rent records which prove rent was last paid on 11 November 2024. The records show the amount owing as at the end of today is $5,342.86.
Given the landlord has succeeded with the claim the tenant must reimburse the filing fee.
The landlord also applied for non-publication of their name and identifying details. As the landlord has succeeded in the proceedings, and I do not consider that publication is in the public interest or is justified because of the landlord’s conduct or any other circumstances of the case, I grant an order for suppression.
