The landlord attended the hearing, the tenant did not attend and did not respond when telephoned on the number ending in 352.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
The fixed term tenancy was to commence on 14 August 2024 and end on 14 October 2024.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
The tenant signed the tenancy agreement, and then failed to make any payments for bond or rent. Despite this, the tenant kept assuring the landlord that he intended to proceed with the property and would be making payment.
Evidence of communications between the parties have been provided through August 2024 and early September 2024. The landlord advised that the tenant had also been at the property at least once during this time.
On 2 September 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The tenant’s father messaged the landlords and advised that the tenant would no longer be taking the property.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated.
Section 61(3)(b) of the Residential Tenancies Act 1986 provides that a tenant who abandons a property, in the case of a fixed term tenancy, is liable to pay rent until the end of the expiry of the tenancy term, or the date of commencement of a new tenancy at the premises.
The landlord has advised that a new tenancy commenced on 2 October 2024. As this is earlier than the end of the tenancy term, the tenant is liable to pay rent until 1 October 2024.
