Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to pay rent as required and failing to occupy the premises himself as required by s 14 of his tenancy agreement.

The landlord served 14-day notices on the tenant with respect to the breach of s 14 on 18/11/2024, and the tenant did not remedy the breach within the required period.

It would be inequitable to refuse to terminate the tenancy because the tenant has been absent from the property for many months and must continue not to live there for some considerable time.

The landlord has also applied for rent arrears and has provided rent records which prove the amount owing. The tenancy could also be terminated under s 55 which states that the Tribunal must terminate a tenancy where the rent is more than 21 days in arrears, which it is.

The landlord said that the possession order will not be enforced before Monday 6 January 2025, due to the impending Christmas season. That is a generous gesture, and the maximum timeframe that can be permitted. The tenant understands that the occupants of the house will need to return the key and possession of the property on this date.

The applicant requested name suppression for the tenant, which is approved as he attended the hearing and engaged fully in the process. He will now contact his probation officer and get assistance with requesting a transfer to a new tenancy.
