Reasons

The landlord attended the hearing which was held by teleconference on 9 April 2025. The Tribunal was unable to contact the tenant on the contact number provided. I was satisfied that adequate service of the hearing notice had been completed and deemed it reasonable to proceed with the application in the tenant’s absence.

Did the tenant comply with their obligations?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (“RTA”). The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) RTA. The tenant must also replace standard light bulbs.

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

This matter concerns a claim brought by the landlord seeking compensation for extensive damage, cleaning, and rubbish removal costs following the end of the tenancy. The landlord submitted a range of evidence including entry and exit inspection reports, detailed photographs, and multiple invoices for work completed.

Upon reviewing the evidence, I am satisfied that the property was left in an extremely poor and unacceptable condition. The photographic evidence, in particular, reveals substantial destruction throughout the premises, including but not limited to: extensive graffiti, holes in walls, unknown substances (likely faeces) smeared across surfaces, removal of fixtures and fittings (such as curtains), and significant damage to windows, locks, flooring, ceilings, and doors.

The damage observed far exceeds fair wear and tear and is of a scale and nature that reflects intentional or reckless conduct.

The landlord undertook extensive remedial work, reflected in the following invoices: a. Invoice 1466 dated 10 March 2025 for $5,241.21 (excluding vinyl and electrician work), relating to urgent repairs. b. Invoice 1465 dated 10 March 2025 for $9,369.21 for general repairs and maintenance. c. Invoice 0573 dated 26 September 2023 for $1,086.75 to replace entrance locks and broken windows during the tenancy. d. Invoice 1197 dated 15 October 2024 for $4,778.25 for rubbish removal. e. Invoice dated 19 February 2025 for $5,601.39 relating to wall repairs and glass disposal.

These invoices are consistent with the damage observed in the photographs and reports. I am satisfied that the costs are reasonably incurred and directly linked to the tenant’s breach of obligations. The damage and subsequent remedial work are a direct consequence of the tenant’s failure to maintain the premises and prevent damage, as required under sections 40(1) and 40(2) RTA.

I also note that following initial repairs, the property was broken into and damaged again by a member of the tenant’s family. Section 41 RTA makes the tenant liable for the actions of people they allow on the premises. In these circumstances, the tenant is responsible for the damage caused by that family member, especially as there is no indication that the landlord contributed to the security lapse or that the individual was a stranger to the tenant.

As the landlord is wholly successful with their claim, I order the tenant to reimburse the filing fee and grant suppression of the landlord’s name and identifying details.
