Reasons

The landlord attended the hearing. The tenant did not attend and did not respond when telephoned on the number ending in 928.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and reimbursement of the filing fee.

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by failing to pay rent arrears.

The landlord served rent arrears notices on the tenant on 15 November 2024 and 1 November 2024, and the tenant did not remedy the breach. Although these notices were not strictly in accordance with section 56(1)(b)(i), I am satisfied that they were sufficient to advise the tenant of the outstanding rent arrears, the amount, the requirement to pay the rental arrears and the application for termination of the tenancy being a consequence of non- compliance with the notices. The tenant failed to pay the rental arrears in response to these notices.

It would be inequitable to refuse to terminate the tenancy because the rent arrears date back to October 2024. The landlord has tried for months to discuss the rent arrears with the tenant, including trying to arrange payment plans, however the tenant has failed to engage.

The tenancy is terminated. Possession is granted on 11 May 2025 to allow the tenant time to move out of the property.

The landlord has also applied for the rent arrears and has provided rent records which prove the amount owing of $1,928.57 through to 4 May 2025.

Because A Cube Rentals Limited has wholly succeeded with the claim I must reimburse the filing fee. R Harvey-Lane 05 May 2025
