[The tenant/s] must ensure that MSD has an income related rent assessment reinstated for the tenancy not later than 27 February 2025, so the arrears do not increase beyond that date.
If the tenant fails to meet the requirements of Order 3 by the due date: a. The tenancy at Unit/Flat 1230, 72 Nelson Street, Auckland Central, Auckland 1010, will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
The arrears have arisen since 5 July 2024. On that date the rent increased from an income related rent assessed at $84.00 per week, to a market rent of $510.00 per week. The tenant has paid some rent at that higher rate but has had inconsistent employment.
The landlord has provided records proving the amount owed.
The evidence suggests that the tenant was notified by the landlord on 19 April 2024 that the rent would increase to a market rent from 23 June 2024 and that the tenant should contact MSD to “...get it sorted ASAP”. The tenant does not recall than communication.
The Tribunal was able to make contact with Mr L from Lifewise Trust, who has had some involvement, though [the tenant] is not his direct client. Mr L has been most helpful in confirming that he will make an appointment for [the tenant] to meet with MSD and assist him with that meeting, with a view to an income related rent assessment being reinstated and the arrears addressed.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
If an income related rent assessment is put in place in terms of Order 3 but some arrears remain, the landlord may apply for further orders to address those arrears.
Because [The applicant/s] has succeeded with the claim I must reimburse the filing fee.
