Iosefa Foluena and Jacinta Ipiniu must pay [The landlord/s] $455.57 immediately, in accordance with the following table:
The Bond Centre is to pay the bond of $600.00 ([Bond number suppressed]) to [The landlord/s] immediately.
[The landlord/s] must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.
The landlord may dispose of the other goods left at the premises by the tenant as the landlord sees fit.

Reasons

The landlord attended the hearing represented by Ms Jaftha.
There was no appearance for the tenants, and they did not answer the calls made to their phones during the hearing. The notice of hearing had been served on them via their email addresses, and they had been reminded by email and phone. Accordingly, pursuant to section 91B(2) of the Residential Tenancies Act 1986 (RTA) I am satisfied that the tenants have been adequately served and as such in accordance with section 92 of the RTA, the hearing went ahead in their absence.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing at the end of the tenancy. The amount owing accounts for the notice period the tenants gave in their vacate notice that was left at the premise.
The landlord has applied for and order for the disposal of goods the tenants left at the premises at the end of the tenancy. The landlord attempted to contact the tenants by phone and email and even went looking for them but could not reach them.
Accordingly, it is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) RTA. Any personal documents must be taken to the local Police station for safekeeping for the tenants.
Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee.
The landlord has applied for suppression orders in their favour, and as they were successful in their claims, pursuant to section 95A of the RTA I approve that application.
