Reasons

Both parties attended the hearing via teleconference.
The landlord, Mrs Hannigan, has applied for termination of the tenancy, rent arrears and refund of the bond.
During the hearing, Ms McDonald admitted that she had used the rent money for Christmas and her children's birthdays instead of paying her rent. As a result, she fell into rent arrears.
I appreciate the financial pressures Ms McDonald may be facing, the issue here is that WINZ has already provided assistance specifically for rent. When that money is diverted to other expenses, it is unlikely that WINZ will cover the arrears again.
At the same time, I must also consider the position of the landlord who has financial responsibilities as a trustee of the property. She has the right to expect that rent will be paid in full and on time.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
I am not aware that there’s a bond in the Bond Centre.
Mrs. Hannigan has agreed to give Ms. McDonald until 28 February 2025 to find a new accommodation.
I strongly encourage Ms McDonald to speak with WINZ or Kāinga Ora as soon as possible to explore her housing options. Other compensation
The landlord has sought compensation for various costs, including damage to the lawnmower, carpet and panel heaters.
During the hearing, the landlord decided to withdraw her claims for other compensation because she will conduct a final inspection after the tenant has vacated the premises.
